Giveaway RULES & REGULATIONS
1. CONTEST PERIOD
The Giveaway entry period commences at 9.00am September 2nd, 2015 and concludes at 5 p.m. ET on October 10th, 2015 (the “Contest Period”).
2. ELIGIBILITY
We thank everyone for their submissions.
The Contest is open to legal residents of Canada and the US over the age of majority in their province or state of residence at the time of entry, with a valid e-mail address, excluding residents of Quebec and where prohibited by law.
People outside Canada and the US are welcome to submit except where prohibited by law, but are not eligible for prizes.
This contest is governed by the Laws of Ontario.
Employees, Contractors, Directors, and Officers of the “Contest Sponsors”: Hop To It Productions Inc, (The Producer), The Pet Network (the Broadcaster), and any affiliate (as defined in the Canada Business Corporations Act) of the Contest Sponsors, employees, directors and officers of their respective advertising and promotional agencies, as well as family members of any of the foregoing or those with whom they are domiciled are not eligible to enter the Contest.
You can enter once per 24 hours for the contest period.
If it is discovered that you have attempted to enter multiple times using multiple identities, or email addresses, all of your entries will be declared null and void, and any prize you might have been entitled to will not be awarded.
Entries should be from individuals not Companies. However stories, events, listings and photos are welcome at any time from Families, Rescue Organizations, Therapy Dogs and Organizations, Service Dogs and Organizations, Breed Groups, Companies, Vendors and Service Providers. You can submit multiple photos and videos to the website through the submit button (must be registered) or on our Facebook page www.facebook.com/talenthounds.
Entries must be received during or before the end of the Promotion Period. Sponsors reserves the right to post and/or remove your entry or entries on the Website, in its sole and absolute discretion. Sponsors’ decision with respect to whether an Entry complies with these Official Rules is final and binding and may be made by Sponsor at any time, whether before, or after, posting. Entries that are incomplete or do not meet the requirements set forth in these Official Rules may not be acknowledged or posted and may be automatically disqualified.
3. HOW TO ENTER
NO PURCHASE NECESSARY.
Visitors may enter the Contest during the Contest Period in the following way:
Visit www.www.talenthounds.ca on your computer or mobile device and complete and submit a contest entry form during the contest period. One contest entry is allowed per day during the Contest Period. Only one (1) email address and one (1) entrant can be associated with each account. All comments on the 3 Top Dog Books Posts (Adult Fiction and Non-fiction, and Kids) will also be entered in the draw.
Entrant can upload unlimited number of different photos and stories to the Gallery or a Profile or Facebook.
STANDARD MOBILE DEVICE CHARGES MAY APPLY.
Entries must be submitted to the website or to the organizers no later than 5.00pm ET at the last day of the contest period. The Contest Organizers and Sponsors take no responsibility for entries that are lost, misdirected, delayed, or received after the Contest deadline. By submitting an entry, entrants agree to be bound by these official rules and regulations. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be deemed to be made by the authorized account holder of the e-mail address at the time of entry. The authorized account holder is the natural person who is assigned an e-mail address by an Internet service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question.
4. WINNER SELECTION
(i) After the Contest Period ends, judges from Hop To It Productions will select the winning entries by random draw for each book, check for eligibility and he/she will potentially be awarded the Prize Package (as defined in section 5 below).
(ii) The potential Prize winners will be contacted by a representative of one of the Contest Sponsors within ten 10) business days through email or phone, as provided by the entrant’s account information and must answer a skill-testing question correctly. They may also be interviewed. Potential Prize Package winners found to be ineligible, decline to accept the Prize Package, who are unable to be contacted (including failing to return emails) within five (5) business days from the time the Contest Sponsors contact the potential winners, and/or who fail to reply within the allotted time period or can not answer the skill testing question correctly, will forfeit the Prize Package.
(iii) If there is no entrant who enters in a Contest Period, no prize will be awarded.
(iv) If the contacted Potential Winner has forfeited or unable to claim the Prize Package, the Contest Sponsors will conduct a random draw of the entries submitted during the Contest Period to select the next Potential Winner and they will be contacted within ten (10) business days through email – ten (10) days from the time the previous Potential Winner forfeited his/her Prize Package.
(v) The Contest Sponsors shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof in a form satisfactory to Contest Sponsors may result in disqualification. All personal and other information requested by and supplied to Contest Sponsors for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Contest Sponsors reserve the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
If, as a result of an error relating to the entry process, drawing or any other aspect of the contest, there are more potential winners of prizes than contemplated in the contest rules, there will be a random draw amongst all eligible prize claimants after the contest closing date to award the prizes.
5. THE PRIZE PACKAGES AND PRIZE VALUE
There are 8 Prizes to be won.
Each Prize Package consists of the following:
Not exchangeable for cash.
Allow at least 1 week for shipment of any prize after verification of the address provided, or pick up at the event.
All taxes on prizes are sole responsibility of the winner.
6. DEADLINE FOR CLAIMING A PRIZE
Following the confirmation as a prize winner in accordance with the Contest Rules, selected entrant will be given instructions and a deadline as to how they must claim the prize. Potential winners who fail either to claim the prize or to inform the Contest Sponsors his/her inability to claim the prize before the deadline, as instructed, will forfeit the prize. Entrants are responsible to keep their contact information up to date with the Contest Sponsors via email. The Contest Sponsors will not be held responsible for the loss of prizes due to changes in email addresses, mailing addresses, errors in completed entry forms or any other circumstances leading to an invalid, erroneous or incomplete mailing address or e-mail address.
7. PRIZE CONDITIONS
(i) Lost or stolen prize will not be replaced by Contest Sponsors
(ii) Shipping cost for the Prize Packages will be provided by the Contest Sponsors
8. CHANCES OF WINNING
One winner will be selected in a random drawing from all eligible entries received within the contest period. Odds of winning depend on the number of eligible entries received during the contest period.
9. NO REPRESENTATIONS OR WARRANTIES
None of the Contest Sponsors makes any representation or offers any warranty, expressed or implied, as to the quality or fitness of any prize awarded in connection with the Contest. Prize winners understand and acknowledge that he or she may not seek reimbursement or pursue any legal or equitable remedy from the Contest Sponsors should a prize fail to be fit for its purpose or is in any way unsatisfactory to a prize winner.
10. DECLARATION AND RELEASE OF PRIZE WINNER
Before being awarded a prize, the selected entrant, must reply to the Contest Sponsors’ email and indicate that he or she read, understood and accepted these Contest Rules; he or she releases the Contest Sponsors, the Affiliates, and all of their directors, officers, employees, agents as well as their respective advertising and promotional agencies (collectively, the “Releasees”) from any and all liability arising in connection with participation in the Contest and acceptance of a prize, including, without limitation, any financial, legal or moral responsibility or loss or personal injury including death or damage to or loss of property suffered or incurred or arising from participating in the Contest or accepting a prize, whether suffered by the prize winner, or by his or her heirs, administrators, personal representatives or executors, and notwithstanding that such injuries or losses may have been caused solely or partly by any act, omission, negligence or gross negligence of any or all of the Releasees.
11. PRIZE SUBSTITUTION
Prizes and prize portions are non-exchangeable, non-transferable, non-refundable, have no cash surrender value and must be accepted as awarded with no substitutions. The Contest Sponsors reserve the right, in their sole discretion, to substitute and/or modify a prize, or prize portion, with (a) prize(s) of equal or greater value for any reason. Should a winner be unable to claim his/her prize or prize portion as awarded, his/her rights to that prize or prize portion will be forfeited.
12 PRIVACY / USE OF PERSONAL INFORMATION.
(a) By entering the Contest and voluntarily providing personal information including, but not limited to, name, address, city, email address, home and office telephone numbers (the “Registrant Information”), each entrant grants permission to the Contest Sponsors to collect and use the Registrant Information for the exclusive purpose of administering the Contest and selecting the prize winner(s). including but not limited to contacting and announcing the Winners; and (ii) acknowledges that the Sponsors may disclose his/her Personal Information to third-party agents and service providers of any of the Sponsors in connection with any of the activities listed in (i) above.
(b) By opting-in online you consent to the Contest Sponsors that you may be contacted to promote draws and contests similar to the Contest, promote opportunities to subscribe to newsletters or promotional clubs, and notify you about related products or services.
(c) The Sponsors will use the entrant’s Personal Information only for identified purposes, and protect the entrant’s Personal Information in a manner that is consistent with the Contest Sponsors’ Privacy Policy:
13. TERMINATION/MODIFICATION
Subject to applicable law, the Contest Sponsors reserve the right to cancel, suspend, terminate, modify the Contest Rules or administration of the Contest, in whole or in part, without prior notice with no obligation or liability, including, if for any reason, the Contest is not capable of running as planned. Please check back regularly.
14. ASSIGNMENT OF RIGHTS
By submitting a story, video or photographic image, for good and valuable consideration, the sufficiency and receipt of which you hereby acknowledge, you hereby grant to Hop To It Productions In, Talent Hounds and its affiliates a non-exclusive, perpetual, world-wide, royalty-free license to use, edit, reproduce, modify, publish, distribute, telecast, syndicate, license, print sublicense, create derivative products and otherwise exercise all copyright and publicity rights with respect to it at our sole discretion without payment to you or any third party, including incorporating it in other works in any media now known or later developed including, without limitation, published books, TV series, films, videos. All such other works will be the sole property of Hop To It Productions and all copyright for such works will reside with Hop To It Productions.
If you do not wish to grant these rights, it is suggested that you do not submit a dogs’ story, photographic image or video.
Hop To It Productions Inc reserves the right to select, edit and arrange submissions, and to remove text and images from the www.talenthounds.ca website or works at any time at its sole discretion.
Your submissions are deemed non-confidential and Sponsors have no obligation to maintain the confidentiality of information and images, in whatever form, contained in any submission, except pursuant to the Talent Hounds Privacy Policy.
You represent and warrant to the Sponsors that you have the full legal right, power and authority to grant to Hop To It Productions Inc the license provided for herein, that you own or control the complete exhibition and other rights to the materials you submitted for the purposes contemplated in this license and that neither the materials nor the exercise of the rights granted herein shall infringe upon or violate the right of privacy or right of publicity of, or constitute a libel or slander against, or violate any common law or any other right of, any person or entity. Users may be held legally liable for the contents of their submissions, for example, for material protected by copyright, trademark, patent or trade secret law or other proprietary right without permission of the author or owner, or defamatory comments.
15. TAMPERING
If for any reason the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the reasonable control of the Contest Sponsors that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Contest, the Contest Sponsors reserve the right, at their sole discretion to cancel, terminate, modify, extend or suspend the Contest and/or prizes. The Contest Sponsors further reserve the right to disqualify, from this Contest and future contests of the Contest Sponsors, any individual who tampers with or in any way corrupts the entry process. The Contest Sponsors may prohibit an entrant from participating in the Contest or winning a prize if, in the Contest Sponsors’ sole discretion, the Contest Sponsors determine that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or the Contest Sponsors representatives. Any attempt by an entrant or any other individual to deliberately damage any web site, mobile application, or undermine the legitimate operation of the contest may be in violation of criminal and civil laws and should such an attempt be made, the Contest Sponsors reserve the right to seek remedies.
